Accordingly, we devote the necessary resources and efforts to processing your data in full compliance with Regulation (EU) 2016/679 (the "General Data Protection Regulation" or "GDPR"), as well as any other legislation applicable in Romania.

Since transparency is one of the essential principles of this legal framework, we have prepared this section to inform you how we collect, use, transfer and protect personal data when you interact with us in connection with our products and services – including through shop.laviprotect.ro.

We reserve the right to periodically update and amend this Privacy Policy to reflect changes in how we process personal data or in applicable legal requirements. When changes occur, we will publish the updated version on our website. We therefore recommend checking this Privacy Policy periodically.

Through this Policy we inform you about how we collect, use, transfer and protect your personal data. We process such data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (the “General Data Protection Regulation”, hereinafter the “GDPR”), and relevant national legislation on personal data protection.

2. PURPOSE OF THE PRIVACY POLICY

This Privacy Policy applies to the personal data we collect about you for the purpose of providing our products and services.

We have developed this Privacy Policy to inform you how Lavi Protect collects, uses and processes personal information across all the websites it owns, including this website.

By using this website, you agree to the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use this website. We encourage you to review this Privacy Policy periodically to stay informed about any changes and how information may be used.

3. HOW DO WE PROCESS YOUR PERSONAL DATA?

LAVI PROTECT SRL, acting as Data Controller, processes the personal data of individual customers, representatives of corporate customers, applicants for available positions, employees, contractual partners and collaborators, and other natural persons interacting with the Company and/or entering into contractual relationships with it.

Personal data is:

• processed lawfully, fairly and transparently in relation to the data subject;
• collected for specified, explicit and legitimate purposes and not subsequently processed in a manner incompatible with those purposes;
• adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed;
• accurate and kept up to date;
• kept in a form permitting identification of data subjects for no longer than necessary for the purposes for which the data is processed;
• processed in a manner that ensures appropriate security, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.

 

4. WHAT TYPES OF PERSONAL DATA ARE PROCESSED AND FOR WHAT PURPOSES?

 

For customers making online purchases and using the Lavi Protect website, we may collect the following information:

• Contact details, meaning any information enabling Lavi Protect to contact you (e.g. name, address, email address, telephone number, etc.) 
• Password, if you choose to create an account on laviprotect.ro.
• Location information (e.g. postcode, city, district/county, etc.).
• Favourite products, products ordered and order history.
• Payment-related information – billing address – bank account.
• Registration or sign-in information requested by the Lavi Protect website (e.g. login ID/email, username).
• Consumer feedback, meaning information you provide on shop.laviprotect.ro about your experience using products and services (e.g. comments and suggestions, testimonials, reviews or other information relating to products sold by Lavi Protect).

In the context of staff recruitment, we process the following personal data: first and last name, address, date of birth, citizenship, gender, telephone number, email address, professional and/or social experience, education and training, skills, and other personal data contained in submitted CVs and cover letters and, where applicable, obtained during job interviews.

For the conclusion and performance of service agreements and partnership/collaboration agreements, we mainly process the following personal data: first and last name, home/residential address, email address, telephone number and the names of certain products or services you own.

 

For completing and submitting the contact form (“Contact”) and the order form (“Order”) on the LAVI PROTECT SRL website (hereinafter the “website”), we process the following personal data: first and last name, email address, telephone number and, where applicable, any other information voluntarily provided by the data subject in the “Request a Quote” section.

 

For website visitors, we may collect data through cookies or similar technologies, including IP address, web browser, location, pages visited on our website, time spent on the website, internet network and device used. For further information, please consult our Cookie Policy.

 

We do not use your personal data to send marketing communications, such as newsletters, unless you expressly consent to such communications by selecting a relevant consent checkbox. In this case, we process only your email address and ensure that you have an easy way to unsubscribe or withdraw consent to receiving these communications at any time.

Lavi Protect does not intentionally request or collect personal data from minors. If it discovers that it has accidentally collected a minor's personal data, it will delete the data as soon as possible while observing the statutory period.

Lavi Protect does not collect data from sources other than those mentioned above.

To improve the quality of our telephone services, we may record your conversations.

When you speak to Lavi Protect representatives by telephone, calls may be recorded to assess service quality and your level of satisfaction, with a view to improving our services. You will be informed before the call begins; if you continue the conversation, we will consider that you have consented to the call being recorded.

If you do not agree to the recording of the call, you can contact us through the other channels listed in the Contact section of our website. You may withdraw your consent at any time, during the call or afterwards. However, withdrawing consent will not affect processing already carried out on that basis, including recordings already made. Certain personal data recorded in this way may also continue to be retained based on legitimate interests or a legal obligation.

The processing activities described in this section are based on your consent, expressed by continuing the call. In addition, the data collected may be processed on the basis of legitimate interests for purposes including checking and improving service quality, evaluating our team's performance, identifying possible fraud, transcription, and developing statistical and analytical models for such analyses.

5. WHAT ARE THE LEGAL BASES FOR PROCESSING PERSONAL DATA?

Your personal data is processed for the following purposes:

• Purchasing products from the online store shop.laviprotect.ro:
  Our website allows you to purchase products online. If you purchase one or more products from our online catalogue, you will be asked to provide personal information such as your first name, last name, address, telephone number and email address. This information is used to complete your purchase and confirm your order.
  Note: Lavi Protect does not store sensitive customer information such as payment card details, identity card series and number, Romanian personal identification number (CNP), etc. Such information may be requested and stored by Lavi Protect's payment-processing partners. You may choose cash on delivery if you do not wish to provide payment details to Lavi Protect's partner payment processors (Netopia, Oney, TBI, etc.).
• Account maintenance: 
  For creating and maintaining your accounts on the Lavi Protect website, including any loyalty and rewards programmes associated with your account.
• Customer service:
  To provide customer service, including responses to enquiries, complaints or general feedback about our products. Customer service may be provided through various means of communication, such as email, letters or telephone.
• Customer engagement:
  To actively engage customers in learning about our products and services. This may include publishing user-generated content, for example customer comments.
• Personalisation:
  In certain situations, Lavi Protect may combine your personal data collected from one source (e.g. a website) with data collected from another source. This provides a more complete view of the customer.
• Marketing communications:
  Lavi Protect SRL collects and processes your personal data for commercial communications such as email and SMS only with your explicit consent. Lavi Protect SRL may also use your personal data for commercial communications on other websites, including social networks of which you are a member, by matching activities and information collected on our websites with those collected on third-party websites (“Targeted Advertising”). These commercial communications will keep you informed of the latest news, events, special offers and promotions concerning Lavi Protect brands and products. Such communications are carried out using “Cookies”. If you no longer wish to receive such communications, you must refuse cookies when accessing our website. 

  We carry out these commercial communications through third-party services (Google Adwords, Facebook, TikTok, etc.). These services may have access to various types of data about you, which they collect from the websites you visit or the social networks you use.

  You can change these preferences by refusing the cookie policy, which will result in your exclusion from our lists for subsequent “Targeted Advertising” campaigns. You can also visit the websites of social networks you belong to and review the options they provide for “Targeted Advertising”.

  Please note that you may continue to receive administrative communications from Lavi Protect SRL, including order confirmations, notifications relating to your account activities (account confirmation, password changes, etc.) and important announcements, even if you refuse the cookie policy.

• Newsletters and emails.
  If you provide us with your email address (whether as part of registering on our general website or for a specific newsletter or communication), the contact information provided will be used to send you the requested newsletter. If you no longer wish to subscribe, you can use the included unsubscribe button. 
  We may also use your email address to send transactional or administrative communications (for example, a confirmation email when purchasing a product online, or when registering for or unsubscribing from a specific registration or activity), as well as announcements relating to certain services (for example, updates to our privacy notice, interruptions or changes to our online services, technical support policies or other related changes). Together, these types of communications are referred to in this Privacy Policy as “Administrative Communications”.
   
• Prize draws, contests and promotions. To register for online prize draws, contests or other promotions (collectively, “Promotions”), you may first be asked to register on shop.laviprotect.ro. Information collected during a promotion is used to determine your eligibility, notify you if you are a winner and/or deliver a prize. If you win, certain information about you (such as your name and image) may be posted on shop.laviprotect.ro or LAVI PROTECT's social media pages. If minors are permitted to participate in a promotion, we will first obtain parental consent where required.
  For further information about promotions, please consult the official rules or details published for the relevant promotion.
• Concluding and performing various contracts;
• For fulfilling our legal obligations;
• On the basis of consent requested and/or given beforehand (in the context of staff recruitment, sending marketing communications, etc.);
• For the legitimate interests pursued by LAVI PROTECT SRL (e.g. adopting measures to protect and ensure the safety of our employees, exercising the Company's legitimate rights and interests in contentious or non-contentious proceedings, etc.).
• Surveys:
  Lavi Protect occasionally sends surveys requesting information about service quality or preferred locations for activities. In these surveys, you may be asked to provide certain personal data, for example age, gender, city and preferences. This information is anonymous.

 

6. HOW LONG DO WE PROCESS YOUR PERSONAL DATA?

Personal data is stored for processing for the time necessary to achieve the purposes described in this Policy or for the period required by law (e.g. for archiving, accounting, etc.).

 

7. TO WHOM DO WE DISCLOSE PERSONAL DATA?

Lavi Protect will never disclose your personal data to a third-party business organisation intending to use it for direct marketing unless you have expressly consented to this.

We will not disclose or transfer any personal data collected from or about you to third parties except:

• Public authorities and institutions – where required by law or for a legitimate interest (defending the Company's rights in contentious or non-contentious proceedings, etc.).
• The Company's contractual partners or collaborators providing web hosting (ALEXE EMIL PFA), website development (ALEXE EMIL PFA), website maintenance (ALEXE EMIL PFA), online marketing and marketing communications (ALEXE EMIL PFA). Employees of partner companies may come into contact with your data, but only in order to improve the quality of the services we provide through the integration of various software solutions.   
• Lavi Protect does NOT provide personal data to any partner based outside the European Economic Area or storing information outside the European Economic Area. Customer and partner data is stored within the European Economic Area.
• Affiliated companies. Lavi Protect may provide your personal data to affiliated companies for specified and legitimate purposes.
• Courier services. Where they need your personal data to make a delivery.

From time to time, we may run a joint, co-sponsored or promotional programme on our website with another company, organisation or party, and we may collect and process personal information. If your personal information is collected by (or shared with) a company other than Lavi Protect as part of such a promotional project, we will notify you when collecting your personal information.

If you do not want your information to be collected by or jointly with a company other than ours, you can always choose not to register for or participate in such promotions when personal information is requested.

We may use third parties such as service providers, agents or contractors to support the internal operations of our website and help manage the website or its various features, programmes and promotions. Some of these third parties may be located outside the country from which you accessed this website.

For example, our main chat messaging service provider stores data in Europe. When you use our chat, the data is stored on that provider's servers. These third parties and their employees may have access to your personal information. Any such third party must at all times provide the same level of security for your personal information as Lavi Protect and, where necessary, be legally bound to keep your personal data secure and process it only on Lavi Protect's specific instructions.

7.1 Legal and business transfers

We may also disclose your personal information if required by law or where, in our good-faith opinion, such action is reasonably necessary to comply with legal proceedings, respond to claims, or protect the safety or rights of Lavi Protect, its customers or the public.

If Lavi Protect is merged with or acquired wholly or partly by another company, or sells or otherwise transfers all or part of its business, the acquirer may gain access to information held by Lavi Protect, which may include personal information, subject to applicable law. Similarly, personal information may be transferred as part of a corporate reorganisation, insolvency proceedings or another similar event where permitted by, and carried out in accordance with, applicable law.

7.2 What happens if you refuse to provide personal data?

If you choose not to provide requested personal information, you may be unable to participate in certain activities or personalised features on our websites, may have limited access to services and special offers, or may be unable to place an order. For example, if you refuse to share your email address, you will not be able to receive newsletters, register on our websites or place an order. If you refuse to provide your name, address, telephone number or email address, you will not be able to purchase products from a Lavi Protect online store. However, you do not need to provide any personal information merely to browse our websites and learn more about our products.

 

8. WHAT ARE YOUR RIGHTS AS A DATA SUBJECT?

If Lavi Protect cannot fulfil your request, we will provide the necessary explanation. You also have the right to request correction of inaccurate information in your personal data. If you have an account on a Lavi Protect website, you may do so through the “My Account” section. If you do not have a Lavi Protect account, you can send us a request to correct inaccurate data.

9. PERSONAL DATA SECURITY AND STORAGE

LAVI PROTECT SRL implements appropriate technical and organisational measures to ensure a high level of security and protection of personal data. We use suitable security methods and technologies, together with internal policies and working procedures, including controls and audits, to protect personal data collected in accordance with applicable personal data protection laws. Data is transmitted in encrypted form and stored on secure servers.

These measures include, but are not limited to: (i) storing your personal information in secure operating environments that are not publicly accessible and can only be accessed by authorised Lavi Protect employees and our agencies and contractors; (ii) using standard SSL encryption technology to safeguard certain sensitive personal information (such as addresses) during transmission to our websites; and (iii) verifying the identity of registered website users before allowing them to access their personal information.

Lavi Protect may retain personal information you submit through this web page in a database, such as a customer database. Lavi Protect will retain your personal data only for as long as it is used to answer your questions, resolve particular situations or develop improvements and new services, while complying with applicable legal requirements. This means that we may retain your personal data for a period even after you stop using Lavi Protect services or this website. After that period, your data will be deleted.

We remind you that you have the right to access your personal data, the right to object, the right not to be subject to an individual decision, the right to seek judicial remedies, the right to object to data processing and the right to request that your personal data be erased at any time, all subject to the conditions laid down by law.
